Tension Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Tension dating platform, including the Tension mobile application, website, and related services (collectively, the “Service”), which are operated by Tension Global Inc. (“Tension,” “Company,” “we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service.

1. Purpose

These Terms set forth the rights, responsibilities, and obligations between you and the Company in connection with your use of the Service, as well as the conditions and procedures for using the Service.

2. Definitions

For purposes of these Terms:

  • “Service” means the Tension application, website, and all related features, products, content, and services provided by the Company.
  • “User” or “Member” means any individual who agrees to these Terms, creates an account, and uses the Service.
  • “Account” means the account you register to use the Service, including your email address, phone number, login credentials, or other linked identifiers.
  • “Content” means any information or material you upload, post, send, display, or otherwise make available through the Service, including profile information, photos, videos, messages, comments, and other materials.
  • “Paid Services” means subscriptions, premium features, one-time purchases, and any other paid services offered by the Company.
  • “App Store Payment” means any payment processed through a third-party platform such as the Apple App Store or Google Play.

3. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes in the Service, our business practices, legal requirements, or for other operational reasons.

If we make material changes, we will provide notice by reasonable means, such as through the Service, by email, or by other electronic communication. Changes will become effective on the date stated in the updated Terms. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of those revised Terms, to the extent permitted by applicable law.

If you do not agree to the revised Terms, you must stop using the Service and may delete your account.

4. Eligibility and Account Formation

By using the Service, you represent and warrant that:

  1. you are at least 18 years old;
  2. you have the legal capacity to enter into a binding agreement;
  3. you are not prohibited by applicable law from using the Service; and
  4. the information you provide to us is accurate, current, and complete.

Your agreement with us is formed when you accept these Terms, complete the registration process, and we permit your access to the Service.

We may require identity verification, age verification, or additional information where reasonably necessary for safety, fraud prevention, legal compliance, or operational purposes.

We reserve the right to deny registration, suspend access, or terminate an account if:

  • you provide false, misleading, or stolen information;
  • you are under 18;
  • your use would violate applicable law or these Terms;
  • your conduct creates safety, trust, or security risks for the Service or other users; or
  • you previously violated our Terms or policies and attempt to re-register without our permission.

5. Your Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

  • provide accurate and up-to-date information;
  • promptly update your information if it changes;
  • keep your login credentials secure;
  • not sell, transfer, license, share, or assign your account to any other person; and
  • comply with these Terms, our Community Guidelines, and any other policies we make available through the Service.

6. Description of the Service

Tension is a platform designed to help users discover, match with, and communicate with other users. Features may include profile browsing, recommendations, matching, messaging, blocking, reporting, community features, and other tools or functionalities we may introduce from time to time.

We may modify, suspend, discontinue, or improve any part of the Service at any time for business, security, legal, technical, or operational reasons.

Some features may be offered free of charge, while others may require payment or a subscription.

7. Important Safety and Platform Disclosures

Tension is a platform for introductions and interaction between users. We do not guarantee that:

  • any match will lead to a relationship, conversation, or meeting;
  • any user is who they claim to be;
  • any communication, meeting, or off-platform interaction will be safe, successful, or satisfactory; or
  • any user will behave lawfully, honestly, respectfully, or consistently.

You are solely responsible for your interactions with other users, whether online or offline. You should use caution and good judgment when communicating with others, sharing personal information, or meeting in person.

We encourage you not to share sensitive information such as your home address, financial information, government identification details, or other highly personal data too early or unnecessarily.

We may provide safety tools such as reporting, blocking, moderation, and in-app safety guidance, but those tools do not eliminate all risks.

No Background Check Guarantee. Unless we expressly state otherwise, we do not conduct criminal background checks, identity checks, or verification checks on every user, and we make no representations regarding any user’s background, identity, intentions, or conduct.

8. Prohibited Conduct

You agree not to engage in any of the following:

  • impersonating another person or misrepresenting your identity;
  • creating a false or misleading profile, including false statements about age, relationship status, occupation, or other material information;
  • stalking, harassing, threatening, intimidating, abusing, or exploiting another user;
  • using hate speech, discriminatory language, sexually harassing conduct, or other abusive behavior;
  • soliciting money, gifts, financial assistance, investments, or engaging in fraud, scams, extortion, or catfishing;
  • posting or transmitting unlawful, obscene, sexually exploitative, violent, or otherwise prohibited content;
  • posting or distributing child sexual abuse material or any content involving the exploitation of minors;
  • infringing any person’s privacy, publicity, intellectual property, or other legal rights;
  • interfering with the normal operation of the Service;
  • using bots, crawlers, scrapers, automation tools, or other unauthorized means to access the Service or collect data;
  • probing, bypassing, or compromising our systems, networks, security, or authentication processes;
  • using the Service for advertising, commercial solicitation, lead generation, or redirecting users to outside services without our prior written consent; or
  • using the Service in any way that violates applicable law, these Terms, or our policies.

We reserve the right to investigate and take action against any prohibited conduct.

9. User Content

You are solely responsible for the Content you create, post, submit, send, or otherwise make available through the Service.

You represent and warrant that:

  • you own or have the necessary rights to your Content;
  • your Content does not violate any law or infringe any third-party rights; and
  • your Content complies with these Terms and our policies.

By posting or submitting Content through the Service, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, use, reproduce, display, perform, adapt, modify for technical purposes, distribute, and otherwise process that Content as necessary to operate, provide, improve, promote, secure, and support the Service.

This license is limited to the purposes of operating and improving the Service and does not transfer ownership of your Content to us.

We may remove, restrict, review, demonetize, hide, or disable access to any Content at any time if we believe it may violate these Terms, applicable law, third-party rights, our policies, or the safety and integrity of the Service.

Because the Service is social in nature, Content you post may be visible to other users, and you acknowledge the risks associated with sharing Content online.

10. Reporting, Blocking, and Safety Measures

Users may report conduct or Content that they believe is unlawful, unsafe, inappropriate, or otherwise violates these Terms or our policies.

We may, in our sole discretion, review reports and take action including:

  • warnings;
  • reduced visibility;
  • Content removal;
  • messaging restrictions;
  • temporary suspension; or
  • permanent account termination.

Where appropriate and permitted by law, we may share relevant information with law enforcement, regulators, courts, or other authorities to protect users, investigate misconduct, prevent harm, or comply with legal obligations.

We may also take action against malicious, abusive, or knowingly false reports.

11. Paid Services and Subscriptions

We may offer Paid Services, including recurring subscriptions and one-time purchases. Before you complete a purchase, we will disclose material terms such as the price, billing cycle, subscription period, renewal terms, and cancellation method.

Subscriptions. Unless otherwise stated, subscriptions may automatically renew for successive periods until canceled.

If you purchase through an app store or third-party platform, billing, cancellation, renewal, and some refund processes may be governed by that platform’s terms in addition to these Terms.

We may offer different pricing, promotions, benefits, or product configurations based on factors such as time, geography, campaigns, or user segment, to the extent permitted by law.

12. Cancellation and Refunds

You may request cancellation or a refund to the extent required by applicable law or as otherwise stated at the time of purchase.

If you purchased through Apple, Google Play, or another third-party platform, refunds and cancellations are generally handled according to that platform’s policies and procedures.

For purchases made directly from us, refund eligibility, deductions, and settlement terms will be determined based on the purchase disclosures, our refund rules, and applicable law.

If a Paid Service was materially misdescribed or not provided as promised, you may be entitled to a refund or other remedy as required by law.

Deleting the app or deleting your account does not automatically cancel an active subscription. You must cancel through the applicable billing channel unless we expressly provide another method.

13. Service Availability; Suspension or Changes

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

We may temporarily suspend, interrupt, modify, or discontinue all or part of the Service for maintenance, repairs, upgrades, legal compliance, security issues, vendor changes, emergencies, or other operational reasons.

When reasonably possible, we will provide advance notice of material disruptions. In urgent situations, notice may be provided afterward.

14. Enforcement; Suspension; Termination

If you violate these Terms, applicable law, or our policies, we may take enforcement action proportionate to the circumstances, including removing Content, limiting features, suspending your account, or permanently terminating access.

We may suspend or terminate your account without prior notice if we reasonably believe that:

  • you engaged in serious unlawful conduct;
  • you pose a threat to the safety of other users;
  • you repeatedly violate our policies;
  • you engaged in payment fraud, account misuse, or abusive automation; or
  • your continued use creates legal, security, or reputational risk for the Service.

You may stop using the Service and request account deletion at any time, subject to any outstanding payment obligations and our rights to retain certain records as described in our Privacy Policy or as required by law.

15. Privacy

Your privacy matters to us. We process personal information in accordance with our Privacy Policy and applicable law.

Our Privacy Policy describes, among other things:

  • what personal information we collect;
  • how we use it;
  • how long we retain it;
  • when we may share it with service providers, affiliates, or others;
  • whether and how we transfer it internationally; and
  • the choices and rights available to you.

You acknowledge that use of the Service requires the collection and processing of certain personal information that is reasonably necessary to provide and secure the Service.

16. Intellectual Property

The Service, including its software, design, trademarks, logos, branding, text, graphics, interfaces, and other materials, is owned by the Company or its licensors and is protected by intellectual property and other laws.

Except as expressly permitted by us in writing, you may not:

  • copy, reproduce, distribute, modify, create derivative works from, sell, lease, reverse engineer, decompile, or exploit any part of the Service; or
  • use any Company or user information obtained through the Service for commercial purposes without proper authorization.

DMCA / Copyright Complaints. If you believe that content on the Service infringes your copyright, you may send us a notice that includes sufficient information for us to investigate and respond in accordance with applicable law.

17. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, OR THAT THE SERVICE WILL RESULT IN MATCHES, DATES, RELATIONSHIPS, OR ANY PARTICULAR OUTCOME.

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE;
  • ANY USER PROFILE OR CONTENT WILL BE ACCURATE OR RELIABLE;
  • THE SERVICE WILL ALWAYS BE SECURE; OR
  • DEFECTS WILL ALWAYS BE CORRECTED.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  2. ONE HUNDRED U.S. DOLLARS (US $100).

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for our fraud, willful misconduct, or gross negligence where such limitation is prohibited.

We are not responsible for disputes, injuries, losses, or damages arising out of interactions between users or between a user and any third party.

19. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles, except to the extent superseded by applicable federal law, including the Federal Arbitration Act.

Informal Resolution First. Before filing a claim, you and the Company agree to try in good faith to resolve the dispute informally by written notice.

Binding Arbitration. Except for disputes that qualify for small claims court or claims involving intellectual property or injunctive relief, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by final and binding individual arbitration.

The arbitration shall be conducted in English, under the rules of the American Arbitration Association or another mutually agreed arbitration provider, and the seat of arbitration shall be Cheyenne, Wyoming, unless otherwise required by law.

Class Action Waiver. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING.

If this class action waiver is found unenforceable as to a particular claim, then that claim shall proceed in a court of competent jurisdiction located in Wyoming, and the remaining provisions of this Section shall remain in effect to the fullest extent permitted by law.

If arbitration is not enforceable for a given dispute, the exclusive venue for that dispute shall be the state or federal courts located in Wyoming, and you consent to their personal jurisdiction.

20. Notices and Contact Information

We may provide notices to you by posting them within the Service, by email, by push notification, or by other reasonable electronic means.

For general notices to all users, posting within the Service may satisfy our notice obligation. For matters that materially affect your rights, we may provide additional notice where required by law.
